Thank you for your email. I have copied in the Local Authority for their awareness of the changes that you have proposed.
As mentioned before, this was a potential amendment that Sussex Police may consider, however, we still believe this application needs to be heard at a Licensing Panel to ensure all parties are able to be questioned around how your business will operate in practice.
I will be submitting some proposed licence conditions to the Panel for their consideration as part of the hearing. I will forward this document across to you at the same time for your awareness. If you feel they are something you can agree to then please do reply to all regarding this.
Sussex Police will be maintaining their representation against the grant of a new late night refreshment licence and will present our case at the hearing in due course.

I can confirm that I am willing to amend the application as follows:
Late Night Refreshment: Thursday, Friday and Saturday 23:00 01:00
From 23:00 onwards:
The premises will be closed and locked to members of the public
No walk-in customers will be permitted
No collections from the premises
Delivery only via online platforms
Deliveries to residential or business addresses only (no street or open space deliveries)
Only staff members will remain inside the premises to prepare and process orders
All previously proposed conditions regarding CCTV, staffing, incident logs and management will remain in place.
I hope this addresses Sussex Polices concerns and I would welcome confirmation as to whether this amendment would enable the withdrawal of the Police representation.

From a Police perspective, the revised amendments still do not mitigate Police concerns. From a crime & disorder perspective, having people remain in the city centre waiting for food and congregating in a busy hotpot area until 01:00 increases risk. Additionally, there are already a number of other LNR outlets open until late and by another potentially opening this could add to the cumulative effect and the issues that the area already suffers with.
The only potential amendment that Sussex Police may consider is if you moved to delivery only to residential or business addresses from 23:00 01:00 with your premises closed and locked to members of the public from this point. This would mean agreeing to strict conditions around this and food could not be delivered around the corner to a street/open space but only to home or business addresses. The public would not be allowed to attend 8 Pool Valley to place or collect orders from 23:00, everything would need to be done through online delivery platforms with only staff members remaining on the premises to cook and process orders.
Please let me know if this is something you could consider. Either way, the application will likely need to be heard by a Panel so please ensure you are applying for and agreeing to what your business requires.

Further to our recent correspondence, I would like to formally amend my application as follows:

All previously proposed conditions remain in place, including:
No online delivery platforms
Walk-in takeaway only
Minimum of two staff members after midnight
CCTV to Sussex Police standard with 31 days retention
Active queue management and no loitering policy
Clear signage requesting customers to leave quietly
Regular litter patrols
Incident log maintained and available for inspection
I hope this further reduction in both days and hours demonstrates my willingness to minimise any potential impact within the City Safety Area.

Thank you for your email and for sending your proposed amendments to your application across.
Unfortunately, what you have proposed does not change the Police Licensing position as walk ins/in person takeaway is viewed as higher risk than solely delivery. This is because it is still encouraging persons who may be under the influence of drugs or alcohol to remain and congregate in an area in the centre of the city. With your venue in particular you have minimal inside space for customers to wait meaning they will have to wait outside for any orders which increases the risk that they may come into contact with other persons in the night time economy.
Delivery only via online delivery partners means that food is being taken to peoples home to be consumed away from the centre of town with persons not staying in the night-time economy and potentially becoming a victim of crime. Therefore the removal of that, while we acknowledge is a compromise, is unfortunately not a factor that we believe can reduce risk in this case.
The Brighton & Hove City Council Statement of Licensing Policy Matrix is very clear that new Fast Food Venues are a No when considering licensing applications in the city centre and exceptional circumstances would need to be shown and met. East Street and its surround are regularly a Hotspot patrol area for Sussex Police showing the increased risk in this area of the city.
Therefore, Sussex Police will be maintaining their representation and will present the Police case at the Panel Hearing in due course.

I write further to the representation submitted by Sussex Police in respect of our application for a new Premises Licence.
Having carefully considered the concerns raised, we would like to formally amend our application as follows:
Late Night Refreshment: Friday and Saturday only
Hours: 23:00 02:00
No online delivery platforms (no Uber Eats, Deliveroo or similar)
Walk-in customers only
In addition, we are prepared to strengthen our operating schedule and include the following conditions:
Minimum of two staff members on duty after midnight
CCTV system installed to Sussex Police standard with 31 days retention and footage made available upon request
Clear signage requesting customers to leave quietly
Active no-loitering policy enforced by staff
Staff to monitor and manage any queue outside the premises
No seating provided takeaway only
Litter checks conducted every 30 minutes during operating hours
Incident log maintained and available for inspection
Our intention is to operate a small, well-managed takeaway business that does not add to existing issues in the area.
By reducing days, reducing hours, and removing online deliveries, we believe we are significantly limiting potential impact.
We are keen to work constructively with Sussex Police and would welcome the opportunity to discuss any further measures that may assist in resolving concerns.
